Electric Park, Thanksgiving Point


Chalk It Up is Utah’s largest chalk art festival and this year Harrington Center for the Arts will be partnering with Utah Foster Care to create an impactful three-day event that will bring together close to 150 amateur and professional chalk artists to transform our sidewalks into a captivating one-of-a-kind arts experience.

VOLUNTEER GENERAL RELEASE, WAIVER, AND AUTHORIZATION

Release and Waiver. The undersigned (“Participant”) and on behalf of any heirs, assigns, and next-of-kin, in exchange for the license and privilege of access to and participation in Fork Fest 2023 (“Festival”), hereby releases, waives, forever discharges, indemnify, and covenant not to sue Harrington Center for the Arts, its officers, members, employees, volunteers, agents and representatives (“Released Parties”) for any and all loss, damages, claim, demand, action or right of action, arising from or by reason of any injury resulting or to result from participation in the Festival. Participant and on behalf of any personal representatives, heirs, assigns and next-of-kin, agree to hold harmless, defend and indemnify, for any and all loss, damages, claim, demand, action or right of action, arising from or by reason of any injury resulting or to result from participation in the Festival. This contains the entire agreement between the parties hereto and all terms are contractual and not a mere recital. Participant has carefully read the foregoing General Release, Waiver and Authorization as his/her own free and voluntary act. Participant (or in the case of a minor, Participant’s parent or legal representative) is at least eighteen years of age and signs this Release and Waiver voluntarily.

No Insurance. Participant understands that the Released Parties do not assume any responsibility for or obligation to provide Participant with financial or other assistance, including but not limited to medical, health or disability benefits or insurance of any nature in the event of Participant’s injury, illness, death or damage to Participant’s property. Participant expressly waives any such claim for compensation or liability on the part of the Released Parties.

Medical Authorization. Participant hereby consents and authorizes the Released Parties to secure emergency medical treatment for Participant during Participant’s volunteer activities related to the Festival. Participant agrees to be responsible for any and all costs associated with transportation and treatment. Participant hereby releases and forever discharges the Released Parties from any claim whatsoever which arises or may hereafter arise on account of any first-aid treatment or other medical services rendered in connection with an emergency during Participant’s tenure as a volunteer of the Festival.

Photo and Video Release. Participant grants to the Released Parties, jointly, for their own benefit and for the benefit of others, the non-exclusive and perpetual right to (a) interview, photograph, or otherwise capture the image of Participant, both in still and motion pictures, (b) record the voice of Participant, separately and in synchronization with images, by any means known or hereafter discovered, and (c) use and duplicate such photographs or other images, whether in print, videotape, digital, or other formats, and reproduce the voice of Participant, separately or together with such images for all purposes. All copies of Participant’s image, likeness, and voice created or recorded by the Released Parties hereunder shall be the exclusive property of the Released Parties, jointly, and any copyright in any work captured by the Released Parties shall be the exclusive property of the Released Parties will all such rights in and to said work having been transferred hereby.

Acceptance. Participant has read this document, understands the contents, has had the opportunity to obtain legal advice as to its effect, and is under no duress or duty to sign it. This document reflects the understanding of Participant with respect to all matters addressed herein and will be interpreted accordingly.
